Your privacy is important to Cloudvisor, UAB (“we”, “us”, “our”).

Cloudvisor, UAB is the data controller in respect of any of your personal data collected and processed for the purposes set out in section 2 of this Privacy Notice.

We do not sell your information to any third party.

You acknowledge and agree that your personal information may be processed in accordance with this Privacy Notice. Failure to provide any personal information requested may prevent us from entering into a contract with you and from performing under any such contract already entered into.

What information do we collect?

When you purchase products or services, register to use a website, including signing up for our partner portal, online training, blog updates or webinars, fill out a form, or contact us for products and services, we collect information that identifies you. This may include your name, company name, email address, job title and industry.

In addition, some information is also automatically collected when you use our Sites, such as your Internet Protocol (IP) address, your operating system, the browser type, the address of a referring web site, and your activity on our Sites. If you access the Sites from a mobile device, we may also collect information about the type of mobile device you use, your device’s unique ID, the type of mobile Internet browsers you use. We treat this information as personal information if we combine it with or link it to any of the identifying information mentioned above. Otherwise, it is used in the aggregate only.

How do we use the information?

We do not sell your personal information to anyone for any purpose.

We collect and use your personal information to operate and improve our sites and services. These uses include providing you with more effective customer service; making the sites or services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies.

We also use your information to communicate with you. We may also occasionally send you product surveys or promotional mailings to inform you of other products or services available from us and our affiliates, and/or share your personal information with our partners so they may send you information about their products and services. You can opt-out from receiving newsletters or promotional e-mail anytime by following the steps as described in the respective newsletter or promotional e-mail.

Use of cookies

When you visit our website we send “cookies” to your computer and use other technologies to enhance your online experience. A “cookie” can be either permanent (i.e., it remains on your computer until you delete it) or temporary (i.e., it lasts only until you close your browser). Third party recipients of your personal information

The personal information we collect as specified in section 1, may be transferred to, and processed by, service providers assisting with our business activities such as hosting providers, providers of IT support and companies providing website analytics. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose than for delivering the service to us in accordance with our instructions and policies.

We may also access or disclose information about you, including the content of your communications, in order to: (a) comply with the law or respond to lawful requests or legal process; (b) protect the rights or property of TimeXtender or our customers, including the enforcement of our agreements or policies governing your use of the services; or (c) act on a good faith belief that such access or disclosure is necessary to protect the personal safety of our employees, customers or the public. We may also disclose personal information as part of a corporate transaction such as a merger or sale of assets.

Transfer of your personal information outside of the EU/EEA

Some of the third parties to whom we may transfer your personal information may be located outside of the EU/EEA.

If we transfer any of your personal information to countries outside of the EU/EEA which do not provide an adequate level of protection according to applicable data protection legislation we will always ensure that appropriate safeguards to protect your information are in place. In this respect we may rely on standard data protection clauses adopted by the European Commission or Privacy Shield certification (only relevant to the US). Legal basis for processing your personal information

We will process your personal information in accordance with this Privacy Notice because it is necessary:

  • for the performance or entering into a contract with you, including in order to provide you with our services (cf. Article 6(1)(b) in Regulation (EU) 2016/679 of 27 April 2016);
  • for compliance with our legal obligations in Regulation (EU) 2016/679 of 27 April 2016);
  • for the purpose of furthering our legitimate interests, including in respect of improving or developing services, including our website(s) and application(s), operating our website(s) and application(s), carrying out online marketing and to prevent, detect and investigate fraud or illegal activity ( Article 6(1)(f) in Regulation (EU) 2016/679 of 27 April 2016).

We will also process your personal information on the basis of any consents provided by you, for example to communicate with you about special offers, promotions, events and other news about our services or those offered by our selected partners (cf. Article 6(1)(a) in Regulation (EU) 2016/679 of 27 April 2016).

Protection and storage of your personal information

We take precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction.

The personal information we collect about you will only be stored as indicated below:

Right to access and rectify your personal information

Subject to certain conditions set out in data protection legislation, you have the following rights in respect of your personal information:

  • the right to obtain confirmation as to whether or not we have collected personal data about you, and if this is the case, access to further information about our processing;
  • the right to obtain a copy of the personal information we have collected about you and to transmit said copy to another data controller;
  • the right to update or amend the personal information we have collected about you if it is inaccurate or incomplete;
  • the right to erase or restrict the processing of the personal information we have collected about you;
  • the right to object to the processing of the personal information we have collected about you, including in respect of any information processed for direct marketing purposes; and
  • the right to withdraw any consents you have provided in respect of our processing of your personal information.

Where processing has been restricted, such personal data shall, with the exception of storage, only be processed with the data subject’s consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
